1. What is Digital Inheritance?
Digital inheritance refers to the access, transfer, and management of accounts, data, content, and rights left in the digital environment after an individual’s death. This may include social media and email accounts, cloud storage services (Google Drive, iCloud, Dropbox), cryptocurrency wallets, digital subscriptions (YouTube, Spotify, Netflix), personal blogs and domains, as well as digital artworks and copyright-protected works.
2. Legal Framework in Turkey
There is currently no specific legislation on digital inheritance in Turkey. However, under Article 599 of the Turkish Civil Code, upon the death of the deceased, heirs acquire the estate as a whole. Within this framework, digital assets with economic value are considered subject to classical inheritance provisions. In addition, under the Law on Intellectual and Artistic Works, the economic rights of the author are transferred to the heirs after death. Although cryptocurrencies are not specifically regulated, they are regarded as assets due to their economic value and thus fall within the scope of inheritance law.
3. Practical Challenges
In practice, several challenges arise. The internal policies of platforms such as Google and Facebook may restrict heirs’ access to accounts. Furthermore, if passwords are not shared, heirs may be unable to access digital assets. This issue is particularly critical in cryptocurrency wallets, where the loss of private keys may result in the complete disappearance of assets.
4. Individual Precautions and Solutions
First, individuals should prepare an inventory of their digital assets and securely store their access information. Password managers, physical safes, or secure password-sharing systems may be used for this purpose. Additionally, a “digital will” should be prepared to clearly specify which account or asset will be transferred to whom.
5. Comparative Legal Perspective
A comparative look shows that digital inheritance is more clearly regulated in some jurisdictions. The German Federal Court, in a 2018 ruling, held that a Facebook account could be transferred to heirs. In the United States, certain states have adopted the Uniform Fiduciary Access to Digital Assets Act (UFADAA), which explicitly regulates the inheritance of digital assets. Within the European Union, the General Data Protection Regulation (GDPR) allows member states to establish their own specific regulations on the matter.
